Terms of Service

1. Acceptance of Terms
By accessing, browsing, or using Komore (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Service.
If you are using the Service on behalf of a company, organization, or other legal entity ("Organization"), you represent and warrant that you have the authority to bind that Organization to these Terms, and "you" refers to both you individually and the Organization.
We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 14 days before they take effect. Your continued use of the Service after any such changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account and use the Service. By registering, you represent that you meet this requirement.
The Service is intended for business and professional use. You may not use the Service if you are barred from doing so under any applicable law.
3. Your Account
When you create an account, you must provide accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to notify us immediately at security@komore.tech if you suspect any unauthorized access to or use of your account. Komore will not be liable for any loss or damage arising from your failure to safeguard your credentials.
We reserve the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or remain inactive for more than 12 consecutive months.
4. Your Content & Intellectual Property
You retain full ownership of all data, files, documents, and materials you create, upload, or store within the Service ("Your Content"). Komore does not claim any intellectual property rights over Your Content.
By using the Service, you grant Komore a limited, non-exclusive, royalty-free, worldwide license to host, store, process, transmit, and display Your Content solely for the purpose of operating, maintaining, and providing the Service to you. This license terminates when you delete Your Content or close your account.
You represent and warrant that you have all necessary rights to Your Content and that Your Content does not infringe on any third party's intellectual property or other rights.
5. Cancellation & Refund Policy
5.1 Cancellation Window. You may cancel your subscription at any time. However, refund eligibility is limited to a period of one (1) calendar month from the date of purchase, or after one-twelfth (1/12th) of the total subscription period has elapsed, whichever comes first (the "Cancellation Window").
5.2 Partial Refund. If you cancel within the Cancellation Window, you are eligible for a partial refund of fifty percent (50%) of the total subscription price. The remaining fifty percent (50%) is retained by Komore to cover costs already incurred, including but not limited to:
- Cloud infrastructure and hosting provisioned for the full term
- Third-party software licensing and integration fees
- Royalty and licensing payments to technology partners
- Data processing, security, and compliance expenditures
- Administrative and onboarding costs
5.3 No Refunds After the Window. After the Cancellation Window has closed, no refunds — full or partial — will be issued under any circumstances. Your subscription will remain active until the end of the current billing period, after which it will not renew.
5.4 How to Request a Cancellation. To initiate a cancellation, email billing@komore.tech from the email address associated with your account, or use the cancellation option in your workspace Settings. Refunds, where applicable, will be processed within 10–14 business days to the original payment method.
5.5 Acknowledgment. By completing your purchase, you expressly acknowledge and agree to this cancellation and refund policy. This policy applies regardless of usage, satisfaction, or any other factor.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations. You shall not:
- Use the Service to transmit, distribute, or store material that violates any law or infringes any third party's rights
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
- Upload or distribute viruses, malware, or any other harmful code
- Interfere with, disrupt, or degrade the performance of the Service or its infrastructure
- Use the Service for competitive analysis, benchmarking, or to build a competing product
- Resell, sublicense, or redistribute access to the Service without written authorization
Violation of this section may result in immediate suspension or termination of your account without notice or refund.
7. Service Availability & Modifications
We strive to maintain 99.9% uptime but do not guarantee uninterrupted, error-free, or secure access to the Service at all times. The Service may be subject to limitations, delays, and other issues inherent to the use of the internet and electronic communications.
We reserve the right to modify, update, or discontinue any feature of the Service at any time. For material changes that reduce core functionality, we will provide at least 30 days' advance notice. Planned maintenance windows will be communicated in advance whenever possible.
Komore shall not be liable for any damages, losses, or inconvenience resulting from scheduled or unscheduled downtime.
8. Data Privacy & Security
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
We implement industry-standard technical and organizational security measures to protect your data. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.
9. Termination
You may close your account at any time through your workspace Settings or by contacting support@komore.tech. Cancellation of your account does not entitle you to a refund outside of the Cancellation Window described in Section 5.
We may suspend or terminate your account immediately, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a security risk to the Service or other users.
Upon termination, you will have 30 days to request an export of Your Content. After this period, we reserve the right to delete all data associated with your account. Certain provisions of these Terms (including Sections 4, 5, 8, 10, and 11) shall survive termination.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Komore and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, business opportunities, or goodwill, arising out of or in connection with your use of the Service.
In no event shall Komore's total aggregate liability exceed the amount you have paid to Komore in the twelve (12) months immediately preceding the event giving rise to the claim.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Indemnification
You agree to indemnify, defend, and hold harmless Komore and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) Your Content.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Komore is incorporated, without regard to its conflict of laws provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration authority in the governing jurisdiction.
13. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Komore regarding your use of the Service and supersede all prior agreements.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. Komore may assign its rights and obligations without restriction.
